These Terms of Service ("Terms") govern your access to and use of the Pickaxe influencer marketing platform ("Platform"), operated by Vaquero Group ("we," "us," or "our"). By using the Platform, you agree to these Terms.
Pickaxe provides a SaaS platform for influencer marketing management including AI-powered outreach, creator brief and agreement generation, product seeding via Shopify, affiliate tracking, and content management. You agree to use the Platform only for lawful purposes and in accordance with these Terms.
You must provide accurate information when creating an account. You are responsible for all activity under your account. We may suspend or terminate accounts for violation of these Terms, non-payment, or harmful conduct.
A one-time setup fee of $2,000 applies ($500 deposit at signing, $1,500 due at launch). Monthly AI usage fees are billed automatically. No invoices are issued. All sales are final — no refunds.
AI-generated briefs, agreements, and outreach messages are provided as starting points. You assume full responsibility for their use. We make no guarantees regarding legal sufficiency — consult legal counsel before executing any AI-generated agreement.
You assume full responsibility for any consequences arising from automated or AI-powered outreach, including account restrictions or bans imposed by Instagram, TikTok, or any other platform. Vaquero Group is not liable for such consequences.
The Platform and all underlying technology remain the exclusive property of Vaquero Group. You retain ownership of your content and data. Campaign assets generated within the Platform are for your use only and may not be resold.
We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed fees paid in the prior twelve months. We make no guarantees regarding influencer response rates, campaign outcomes, or lead quality.
Either party may terminate with 30 days written notice. We may terminate immediately for breach or non-payment. Upon termination, you retain access to all data generated during the term.
These Terms are governed by the laws of the State of New York.
